Court Acquits 2 Men Who Allegedly Stabbed Okada Rider To Death

An FCT High Court, Apo, on Monday discharged and acquitted one Ehis Omodiahe, and Mustapher Kabiru, charged with conspiracy, robbery and culpable homicide.

Justice Muawiyah Idris,  discharged and acquitted the defendants for lack of evidence.

Idris said his decision was because the prosecutor failed to prove the case against the defendants beyond reasonable doubt.

According to him, there is no single evidence to prove the offence of conspiracy, armed robbery and culpable homicide, punishable with death.

He also said that in order to secure conviction, prosecution must call vital witnesses to testify and give vital evidence that go to the root of the ingredients.

The judge said that there was only record of confessional statement and testimonies of the investigating police officers in the case.

The defendants, Omodiahe, 32 and Kabiru, 30, of Katampe Mpape , Abuja, were arraigned on Dec. 13, 2016 on charges bordering on conspiracy, robbery and culpable homicide.

The prosecutor, Mr Oyetoba Atoyebi, told the court that defendants committed the alleged offences in March 2016

.He said the defendants, stabbed one Muazu Saidu to death with a knife and made away with his Honda motorcycle.

Atoyebi said the offence was contrary to and punishable under Section 221 of the Penal Code. (NAN)
