The Federal High Court has declined to hear, Mr Jimoh Ibrahim’s suit challenging the legality of Sen. Ahmed Makarfi-led faction of the Party to conduct primaries in the state.
Ibrahim is the PDP governorship candidate of the Sen. Ali Modu Sheriff-led faction of the PDP.

In his ruling, Justice Okon Abang, on Thursday said he was only assigned to hear the matter because he was a vacation judge.

Abang said having regards to the peculiar nature of the case he don’t think the application seeking for interlocutory order might be deserving during this vacation.
According to him, the only time left for the vacation court is less than a week.

He said the only option left was for the case file to be remitted back to chief judge for reassigning to another judge after the vacation.
Abang, therefore, returned the case file to the chief judge of the Federal High Court for reassignment to another judge.

He, however, directed parties to file and serve hearing notices before the court resume from its vacation.
Abang’s vacation will start on Monday, Sept. 12

Ibrahim had in a suit asked the court to stop the Makarfi-led faction from conducting its party primary election for Ondo state on Aug. 22. (NAN)
