NERDC’s absence in court stalls suspended employee’s case

The National Industrial Court, Abuja, on Tuesday adjourned until Oct.16, hearing of alleged unlawful suspension suit, filed by a staff of the Nigerian Educational Research and Development Council (NERDC) due to absence of the defendant.

Justice Rakiya Haastrup adjourned the suit as there was no legal representation for the Council.

The judge also ordered that hearing notice be served on the defendant before the next adjourned date.

The claimant, Zainab Onipe, was suspended in June 2011, over alleged gross misconduct.

When the case came up for mention, the claimant counsel, Wilson Ivara, told the court that the defendant was served with originating processes and hearing notice.

The claimant who was a clerical officer on Grade Level 4 before her suspension, is seeking a declaration that her appointment with the Council is still valid, legal and subsisting.

The claimant is also seeking an order of the court for reinstatement and payment of all her salaries, allowances and benefits from the time of the suspension till date. (NAN)
