The detained Leader of Indigenous People of Biafra (IPOB), Nnamdi Kanu can have access to his medical records and see any doctor of his choice, a Federal High Court sitting in Abuja has ruled.
Justice Binta Nyako granted the relief sought by Kanu in a judgement passed on Thursday.
In the suit marked FHC/ABJ/CS/ 2341/2022, and filed by his team of lawyers led by Mike Ozekhome SAN, Kanu prayed the court for leave to apply for an order of mandamus to compel the Department of State Services (DSS) to allow him access to his medical doctors, among others.
However, the DSS opposed the application for lacking in merit.
Through its counsel, A.M. Danlami, the secret police also challenged the court’s jurisdiction to grant Kanu’s request.
The DSS told the court that Kanu has been receiving adequate medical attention in its custody.
In her ruling, Justice Nyako said that Kanu is entitled to the medical doctor of his choice provided he is prepared to bear the expenses.
The court further held that medical examination of Kanu outside the facility of DSS should be supervised by Kanu’s team of medical doctors and the reports should be sealed for security purposes.
