Court sets March 24 for ruling on dismissal of Saraki’s charges

The ruling on the motion raised by the Senate President, Dr. Abubakar Bukola Saraki requesting the Code of Conduct Tribunal to dissolve and discard charges of false assets declaration levelled against him has been fixed for March 24.

The date for ruling on the case was arrived at by the presiding judge of the Tribunal, Danladi Umar after listening to arguments from both sides of the filed motion.

Arguing for the motion, Saraki’s lawyer, Chief Kanu Agabi, SAN, maintained that amongst other grounds of counter, the jurisdiction for the tribunal to entertain the charges was lacking as the Attorney-General of the federation and Minister of Justice lacked the power to file charges before the tribunal.

Saraki’s lawyer also reminded the court that the Code of Conduct Bureau, CCB, failed to invite Saraki to answer to the allegations as concerning breaches in his declared asset, an act which was fatal to the validity of the charges.

Arguing against the motion, Mr. Rotimi Jacobs, SAN, said the motion in itself constituted an abuse of court process and therefore should be dismissed.

The Senate president who was represented by 80 lawyers at the Friday proceedings will on 24th of March know his fate.
